  RELEASE OF LIABILITY - READ CAREFULLY - THIS AFFECTS YOUR LEGAL RIGHTS

In exchange for participation in the activity of Brazilian Jiu Jitsu organized by Tenfold BJJ LLC, of 17025 Silver Pkwy, Fenton, Michigan, 48430 and/or use of the property, facilities and services of Tenfold BJJ LLC, I agree for myself and (if applicable) for the members of my family, to the following:

1. AGREEMENT TO FOLLOW DIRECTIONS. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Tenfold BJJ LLC, or the employees, representatives or agents of Tenfold BJJ LLC.
2. ASSUMPTION OF THE RISKS AND RELEASE. I recognize that there are certain inherent risks associated with the above described activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Tenfold BJJ LLC for injury, loss or damage arising out of my or my family's use of or presence upon the facilities of Tenfold BJJ LLC, whether caused by the fault of myself, my family, Tenfold BJJ LLC or other third parties.
3. INDEMNIFICATION. I agree to indemnify and defend Tenfold BJJ LLC against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's use of or presence upon the facilities of Tenfold BJJ LLC.
4. FEES. I agree to pay for all damages to the facilities of Tenfold BJJ LLC caused by any negligent, reckless, or willful actions by me or my family.
5. CONSENT. I, (person signing below) of address that is on file, consent to the participation of my son/daughter, in the activity of Brazilian Jiu Jitsu, and agree on behalf of the above minor to all of the terms and conditions of this Agreement. By signing this Release of Liability, I represent that I have legal authority over and custody of (name signed up). 
6. MEDICAL AUTHORIZATION. In the event of an injury to the above minor during the above described activities, I give my permission to Tenfold BJJ LLC or to the employees, representatives or agents of Tenfold BJJ LLC to arrange for all necessary medical treatment for which I shall be financially responsible. This temporary authority will begin on the date signed  and will remain in effect until terminated in writing by the undersigned or when the above described activities are completed. Tenfold BJJ LLC shall have the following powers:
   1. The power to seek appropriate medical treatment or attention on behalf of my child as may be required by the circumstances, including without limitation, that of a licensed medical physician and/or a hospital;
   2. The power to authorize medical treatment or medical procedures in an emergency situation; and
   3. The power to make appropriate decisions regarding clothing, bodily nourishment and shelter.
7. APPLICABLE LAW. Any legal or equitable claim that may arise from participation in the above shall be resolved under State of Michigan law.
8. NO DURESS. I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire. I further agree and acknowledge that Tenfold BJJ LLC has offered to refund any fees I have paid to use its facilities if I choose not to sign this Agreement.
9. ARM'S LENGTH AGREEMENT. This Agreement and each of its terms are the product of an arm's length negotiation between the Parties. In the event any ambiguity is found to exist in the interpretation of this Agreement, or any of its provisions, the Parties, and each of them, explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either "for" or "against" a particular party based upon their status as the drafter of a specific term, language, or provision giving rise to such ambiguity.
10. ENFORCEABILITY. The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this Agreement.
11. DISPUTE RESOLUTION. The parties will attempt to resolve any dispute arising out of or relating to this Agreement through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution (ADR) procedure.

Any controversies or disputes arising out of or relating to this Agreement will be resolved by binding arbitration under the rules of the American Arbitration Association. The arbitrator's award will be final, and any judgment may be entered upon it by any court having proper jurisdiction.

EMERGENCY CONTACT. In case of an emergency, please call person on file.

I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I FURTHER UNDERSTAND THAT BY SIGNING THIS RELEASE, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.

Tenfold BJJ Trial Agreement

This Trial Agreement (the “Agreement”) is entered into between Tenfold BJJ (“the Gym”) and the undersigned (“Trial”). By signing this agreement, the Trial agrees to the following terms and conditions:

1. Trial and Payment Terms

1.1 We agree to give you one free class at no cost as long as you are a resident of Michigan. We under no circumstance are required to give you an additional free trial. 

1.2 You can do one free GI class and one free NO-GI class. Any future free trial classes booked will be canceled. 

1.3 You must put a card on file,this card will not be charged unless you damage tenfold bjj property. 

1.4 You must book at least 12 hours in advance otherwise your trial is subject to cancellation. 

2. Gym Rules and Code of Conduct

2.1 Respect and Compliance: trials agree to respect all staff, coaches, and fellow members. trials are responsible for maintaining a safe and positive training environment.

2.2 Hygiene and Attire:

• Trials must not attend class if they have any skin infections or contagious conditions.

• For gi classes, we provide a GI at no cost.

• For NO-GI classes please wear a t-shirt and shorts. Rashguards are preferred but not required.

• For both gi and no-gi classes, trials agree to wear a clean outfit to each session.

2.3 Prohibited Behaviors: Engaging in the following behaviors is strictly prohibited:

• Talking down to or disrespecting other members

• Slamming, punching, kicking, and eye-gouging,jumping closed guard,scissor takedowns

2.4 Parent Conduct: Parents agree not to coach or provide instruction during classes. The role of coaching is reserved for Gym staff and instructors.

3. Assumption of Risk

3.1 Acknowledgment of Risk: The trial acknowledges that Brazilian Jiu-Jitsu is a contact sport that carries inherent risks of injury. The trial assumes all risks associated with training and participating in Gym activities.

3.2 Liability Waiver: The Member agrees to sign our liability waiver.

4. Right to Amend Policies

4.1 The Gym reserves the right to amend its policies, procedures, and this Agreement at any time. Trials will be notified of any changes in writing.

5. Acceptance and Acknowledgment

By signing below, the Member agrees to abide by all terms in this Agreement and acknowledges that they understand and accept the policies stated above.

6. Photographic and Video Release

6.1  The Trial grants Tenfold BJJ the right to take photographs and video recordings of them during classes, events, tournaments, and activities at the Gym.

6.2 Use of Media: The Trial agrees that Tenfold BJJ may use these photographs and video recordings for promotional purposes, including but not limited to social media,our app, website content, marketing materials, and advertisements, both for the Gym and during tournament events.

6.3 Opt-Out: If the Member does not wish to be photographed or recorded, they must notify the Gym in writing prior to participation in any classes, events, or tournaments.
